Acknowledgment of Homemade Food & Cosmetic Products

I, the ordering customer, acknowledge the following regarding the purchase of any product from Happy Fairy Apothecary, LLC:

  1. Homemade Product: These products were prepared in a home kitchen that is not subject to state or federal inspection or regulation, as permitted under Idaho Code § 39-1607 for cottage food production and cosmetic production.

  2. Not FDA-Approved: These products have not been reviewed or approved by the U.S. Food and Drug Administration (FDA) or any other regulatory authority.

  3. Allergen Information: These products may contain or have come into contact with one or more of the following major food allergens as defined by the Food Allergen Labeling and Consumer Protection Act (FALCPA) and the Food Allergy Safety, Treatment, Education, and Research (FASTER) Act: milk, eggs, fish (e.g., bass, flounder, cod), crustacean shellfish (e.g., crab, lobster, shrimp), tree nuts (e.g., almonds, pecans, walnuts), peanuts, wheat, soybeans, and sesame.  This is not an exhaustive list, the kitchen and work spaces are clean, with great care taken for sanitation, but there is a risk of cross-contamination.

  4. Cross-Contact Risk: These products were prepared in a facility that may process other foods containing the above allergens. Although efforts have been made to prevent cross-contact, there is a possibility of unintentional allergen presence due to shared equipment or preparation areas. Precautionary statements (e.g., "may contain [allergen]") are included where applicable, but the absence of such a statement does not guarantee the product is free of allergens.

  5. Consumer Responsibility: I understand that it is my responsibility to review the ingredient list and contact the producer with any questions about allergens or preparation practices before consuming the product. I acknowledge that consuming or topically utilizing these product may pose a risk to individuals with allergies or sensitivities.

  6. Safety Testing: All products have been reasonably tested for safety among users of various age, gender, and health status, but not all body types, illnesses, allergies known or unknown, medication use interaction, or all physical conditions have undergone testing with all products and not all possible side effects or reactions are known.  Customers use all Happy Fairy Apothecary products at their own risk and are encouraged to research possible risks of the ingredients with their own physical make-up, sensitivities, needs, and medication use.
